WHYNOT? TRAVEL COMMUNITY
GROUP TRIP TERMS & CONDITIONS
1. Organiser Role
1.1 WhyNot? Travel Community, operated by Kunle Fadipe (“the Organiser”), acts solely as a community organiser and group coordinator.
1.2 WhyNot? Travel Community does not provide the travel services included in the trip.
1.3 All ground services including accommodation, transport, activities and guides are provided by an independent local tour operator (“the Operator”).
1.4 By booking the trip, participants acknowledge that the Organiser is not the tour operator or travel agent and is not responsible for the performance of the travel services.
2. Booking and Payments
2.1 A deposit is required to secure a place on the trip.
2.2 The remaining balance must be paid by the deadline communicated to participants prior to departure.
2.3 Failure to complete payment by the required deadline may result in cancellation of the participant’s place without refund of the deposit.
2.4 All payments are non-transferable unless otherwise agreed in writing.
3. Cancellations by Participants
3.1 If a participant cancels their place on the trip, the following terms apply:
• Deposits are non-refundable.
• If cancellation occurs after the final payment deadline, refunds may not be available due to commitments made to the Operator.
3.2 Participants may transfer their place to another traveller with approval from the Organiser if logistical arrangements allow.
4. Cancellation or Changes by Organiser
4.1 In the unlikely event that the trip must be cancelled due to insufficient participants, safety concerns, force majeure or operator cancellation, participants will receive a refund of payments made to the Organiser.
4.2 The Organiser reserves the right to make reasonable changes to the itinerary where necessary due to local conditions, weather, safety concerns or operational issues.
5. Travel Insurance
5.1 All participants must obtain comprehensive travel insurance covering:
• medical treatment
• trip interruption
• evacuation and repatriation
• adventure activities included in the itinerary
5.2 Participants are responsible for ensuring their insurance policy provides adequate coverage for the activities included in the trip.
6. Health and Personal Responsibility
6.1 Participants are responsible for ensuring they are medically fit to travel and participate in the activities included in the trip.
6.2 Participants must bring any required medication and inform the Organiser of relevant medical conditions or allergies.
6.3 Participants must comply with safety instructions provided by guides and the Operator.
7. Passports, Visas and Entry Requirements
7.1 Participants are responsible for ensuring they possess valid travel documents, including passports and visas where required.
7.2 Passports should typically be valid for at least six months beyond the travel dates.
7.3 The Organiser is not responsible for travellers denied entry due to documentation issues.
8. Participant Conduct
8.1 Participants are expected to behave respectfully towards fellow travellers, guides and local communities.
8.2 The Organiser reserves the right to remove any participant from the trip whose behaviour is unsafe, illegal or disruptive.
8.3 In such cases no refund will be provided.
9. Risk Acknowledgement
9.1 Participants acknowledge that travel and adventure activities may involve risks including but not limited to outdoor environments, varying road conditions, altitude and physical activities such as hiking or horse riding.
9.2 By joining the trip participants accept these risks and agree to participate at their own discretion.
10. Limitation of Liability
10.1 WhyNot? Travel Community is not responsible for acts, omissions or negligence of the independent Operator or third-party service providers.
10.2 The Organiser shall not be liable for any injury, loss, damage, delay or inconvenience arising from travel services provided by the Operator.
11. Media and Content
11.1 Participants acknowledge that photographs and videos may be taken during the trip.
11.2 By joining the trip, participants grant WhyNot? Travel Community permission to use such content for marketing, social media and promotional purposes.
12. Force Majeure
12.1 The Organiser shall not be liable for failure to perform obligations where such failure is caused by events beyond reasonable control including natural disasters, government restrictions, political instability, transport disruptions or other unforeseen events.
13. Acceptance
13.1 By booking or participating in the trip, participants confirm they have read, understood and agree to these Terms and Conditions.
13.2 These Terms and Conditions are governed by the laws of England and Wales.
14. Participant Responsibility & Insurance (Summary)
This trip includes a range of exciting activities and experiences as part of the adventure. By joining, you acknowledge that participation is voluntary and you take responsibility for your own wellbeing throughout the trip.
All travellers are required to have valid travel insurance that covers medical expenses, personal belongings, and the activities included in the itinerary.
We take reasonable steps to prioritise the safety and wellbeing of all travellers throughout the trip. However, WhyNot? Travel Community and its partners cannot be held liable for any injuries, loss, or unforeseen circumstances that may occur.
By booking, you confirm that you have appropriate insurance in place and are happy to take part in the trip.
